Included and Excluded Items with Home Purchase.

Inclusions and Exclusions:
Usually only the sale contract provides for what is included and excluded in the sale of the
property so there is no confusion by either party.  For example a buyer might think that the
central vacuum attachments, fountains, and garage door openers are included with the property.  A seller on the other hand may have paid extra for these items and would argue that they are not included as they are not attached to the property and can be moved easily and used at another property.
This is why most sale contracts specifically address any items that are questionable.  The
current St. Louis Association of Realtors approved contract provides a section attached as a
sample below to clearly identify all inclusions and exclusions.
INCLUSIONS AND EXCLUSIONS.
Note: This contract, not the Seller’s Disclosure Statement, the MLS or other promotional
material, provides for what is to be included in this sale. To avoid any misunderstanding,
the parties are urged to list as “included” or “excluded” any items which may be subject
to question. The purchase price includes all existing improvements on the property (if any)
and appurtenances, fixtures and equipment (which Seller guarantees to own free and clear) including:
All Keys and Remote Entry Controls                          Dishwashers & Trash Compactors
Electric Garage Door Opener(s) and Control(s)        Ovens/Ranges/Stoves and Attachments
Exterior Lighting, Landscaping & Mailbox                Built in Microwave Ovens
Invisible Pet Fence Systems & Collars                      Attached Gas Fired Barbecue Grills
Built in Heating, Ventilating & Cooling Systems      Radiator Shields
Attached TV Antennas                                              Built in Plumbing Systems & Fixtures
Satellite Dish(es)                                                      Water Softeners & Sump Pump
All Lighting Fixtures & Ceiling Fans                         All Window Air Conditioning Units
Attached Mirrors and all Bathroom Mirrors             Attached Floor Coverings
Attached Shelving & Closet Organizers                   Curtain & Drapery Hardware
Blinds, Shades, Shutters, & Awnings                        Screens & Storm Windows
Security & Alarm Systems                                         Attached Fireplace Equipment & Doors
Artificial Fireplace Logs                                            Central Vacuum System & Attachments
All Articles Now Provided For Tenant Use
